RULES FOR THE USE OF PICKLEBALL STREET USA’S

SPORTS FACILITIES

Chapter I

General Provisions

Article 1. The purpose of these RULES is to regulate the use of the sports facilities that PICKLEBALL STREET USA has its operations, (hereinafter the “SPORTS FACILITY(S)”).

Article 2. Compliance with these RULES will be mandatory for all users of the “SPORTS FACILITY(S)”.

Article 3.  For the purpose of establishing the scope of application of these RULES, “SPORTS FACILITY” is considered to be any enclosure or construction of PICKLEBALL STREET USA, provided with the necessary means for the learning, practice and competition of one or more sports; the “SPORTS FACILITY” includes the area where physical or sports activity is carried out and its complementary spaces such as warm-up areas, courts, bleachers, bathrooms and warehouses, among others.

Chapter II

About the Use of the “SPORTS FACILITY(S)”

 

Article 4. PICKLEBALL STREET USA may schedule all the activities that according to these RULES are intended to be carried out in “THE SPORTS FACILITIES”.

Article 5.  The “SPORTS FACILITY(S)” may only be used for activities related to the learning, practice and regulated competition of the sports for which they were designed.

Article 6.  “SPORTS FACILITIES” may be used from Monday to Friday from 8:00 a.m. to 8:00 p.m. and on Saturdays and Sundays from 8:00 a.m. to 2:00 p.m., except for official rest days and vacation days indicated in the official calendars of the State of Texas. 

Article 7.  The “SPORTS FACILITY(S)” may be used only by users: (a) who have scheduled and paid the total value corresponding to the programming available for the use of one or more courts; (b) that they have registered on the corresponding website or in person, and (c) that they have previously known and accepted the following documents in physical or digital format:

  • Liability Release – Waiver and Release of Liability
  • Privacy Policy
  • Consent to Communication
  • Any other documents required by PICKLEBALL STREET USA

Article 8. The “SPORTS FACILITY(S)” may be used through the scheduling that is carried out virtually or in person, as long as there is court availability.

Article 9. The loan and use of the “SPORTS FACILITY(S)” entails the obligation to preserve them in the same conditions of use and cleanliness in which they were received.

Article 10. In the “SPORTS FACILITY(S)” whose floor is covered by synthetic grass, rubber or wood, only tennis shoes with soft soles and without metal or hard plastic heels may be worn.

Article 11. Users must have the necessary implements to carry out the activities according to the nature of the “SPORTS FACILITY(S)”.

Article 12. The loan and use of the “SPORTS FACILITY(S)” may be made according to the availability existing at the time of booking.

Article 13. PICKLEBALL STREET USA, the managers and workers who are in the performance of their duties, will not be responsible for the accidental or negligent acts of the users, which lead to any injury, medical repercussion or death of any of them. By making a reservation and accepting the terms and conditions of the registration or entry documents, the user voluntarily, knowingly and expressly assumes full responsibility for any accident or injury that may occur during or after the practice of Pickleball in the “SPORTS FACILITIES”, whether as a result of their own actions or omissions,  of the conditions of the environment, of the health conditions of the user, of the lack of adequate equipment, possible deficiency of the facilities, or of any other circumstance.

Chapter III

Rights and Obligations of Users

 

Article 14. The rights of the user are:

  1. To use the “SPORTS FACILITY(IES)” for learning, practicing and competing in sports in the manner and under the conditions established in these RULES;
  2. To be treated with respect by PICKLEBALL STREET USA staff, security officers and other users of the “SPORTS FACILITY(IES)”;
  3. To submit in writing to PICKLEBALL STREET USA any complaints or suggestions related to the use of the “SPORTS FACILITY(IES)”; and,
  4. To be familiar with the content of these RULES.

Article 15. The user’s obligations are:

  1. To take care of the “SPORTS FACILITY(IES)”;
  • To keep the “SPORTS FACILITY(IES)” clean;
  • To respect the physical integrity of every person who is in the “SPORTS FACILITY(IES)”;
  • To not introduce food into the areas where the sporting activity is carried out;
  • To refrain from consuming alcoholic beverages or any type of drug inside the “SPORTS FACILITY(IES)”;
  • To refrain from taking off one’s shirt.
  • To use the “SPORTS FACILITY(IES)” in accordance with the rules of the sport for which they were designed;
  •  Respect and abide by the restrictions and prohibitions posted at the “SPORTS FACILITY(IES)”; and
  •  To use the appropriate clothing and footwear to carry out any sporting activity;
  • Comply with the other provisions contained in these RULES.

Chapter IV

Sanctions

Article 16. PICKLEBALL STREET USA, through the person in charge of the “SPORTS FACILITY(IES)”, may suspend any activity scheduled or being carried out there, when in its judgment, users fail to comply with any obligation established in these RULES.

Article 17. In the event that a user causes harm to a person or to the “SPORTS FACILITY(IES)” and the circumstances in which it occurred lead to the presumption of intent or negligence, they will be brought to the attention of the corresponding authorities.

These RULES enter into force as of the —— day of October 2024.
