Liability release – Waiver and release of liability

1. LIABILITY RELEASE – WAIVER AND RELEASE OF LIABILITY

In consideration for my guest status at the PICKLEBALL STREET USA, I acknowledge and agree that:

• I am engaging in physical exercise, including but not limited to the use of exercise machines, free weights, Location facilities, training and instruction.
• I risk bodily injury from the various activities offered at the PICKLEBALL STREET USA´s location, including paralysis, dismemberment, disability and death, and while particular rules of the sport, equipment and discipline may reduce the risk, this risk of injury does exist, as well as the risk of damage to or loss of property.
• I willingly agree with the stated and customary conditions for participation in these sports-related activities. If I observe any unusual or unnecessary hazard during participation or if I observe any risk or concern in my readiness in my participation, I will immediately bring such to the attention of the nearest official and refrain from participation.
• I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, hold harmless and promise forever not to sue the PICKLEBALL STREET USA, their officers and staff, sponsors, volunteers, heirs and/or agents (“Releases”) with respect to any and all injury, damage and loss arising from my participation in PICKLEBALL STREET USA´s activities, whether caused by the negligence, gross negligence and/or willful misconduct of the “Releases”, and/or the condition of the premises.
• I agree to be bound by the rules and regulations of PICKLEBALL STREET USA and those of the USA Pickleball Association and I hereby stipulate that I am eligible to participate in the various sporting activities for which I have applied and in which I intend to participate in and that I understand that the above mentioned make no representation or warranty with respect to the condition of the premises or the operation of event.
• I, hereby grant to PICKLEBALL STREET USA, its licensees, sponsors and contractors including photographers, television and motion picture companies, their affiliates and subsidiaries, full photography, television and motion picture rights including authority to film or videotape me during matches, narratives, personal interviews, or comment thereon for any and all commercial, news or other purposes together with the right to transfer or grant their rights to others, all without remuneration or compensation to me whatsoever.
• I have read this document “LIABILITY RELEASE – WAIVER AND RELEASE OF LIABILITY”, fully understand its terms and understand that I have given up substantial rights by signing it, and sign it freely and voluntarily.
• If using any rental equipment or party rooms I understand that I am responsible for any damages to the equipment or facilities. I am also responsible for any lost or stolen rental equipment that was issued to myself or any minors I am signing for.
• I am responsible for any damage caused by myself or minors I am signing for to the facilities by misuse of equipment, or players.

2. MINOR PARTICIPANT WAIVER

 (For Participants Under 18 Years Old)

(Applicable only for parents/guardians who are filling out this waiver for their child)

As the parent or legal guardian of the minor named in this form, I acknowledge and agree that:

• I have read and fully understand the terms of this RELEASE OF LIABILITY AND WAIVER AGREEMENT. I understand that by signing this agreement, I am giving up substantial rights, including the right to sue, on behalf of the minor participant.
• I consent to the minor’s participation in the activities offered at the PICKLEBALL STREET USA and agree to all terms and conditions stated above on behalf of the minor.
• I, for myself, the minor, and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, hold harmless and promise not to sue PICKLEBALL STREET USA, their officers and staff, sponsors, volunteers, heirs and/or agents (“releases”) with respect to any and all injury, damage, and loss arising from the minor’s participation in PICKLEBALL STREET USA´s activities, whether caused by the negligence, gross negligence and/or willful misconduct of the “Releases”, and/or the condition of the premises.
• I grant to PICKLEBALL STREET USA the same rights to photograph and record the minor as stated above, and I acknowledge that the minor and I shall receive no remuneration or compensation for such use.
